These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Dhaval Ajitbhai Shah, operating as Tether Breathwork ("we," "us," or "our"), governing your access to and use of the Tether mobile application ("App" or "Service").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Effective Date" above. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
Tether is a guided breathwork and breathing exercise application designed to help users practice structured breathing techniques for relaxation, focus, and well-being. The App provides audio-guided breathing sessions, session tracking, and related wellness content.
The App is available for download on Apple's App Store for iOS devices.
The App is not a medical device and does not provide medical advice, diagnosis, or treatment. The breathing exercises and content provided through the App are for general wellness and informational purposes only.
You should consult your physician or other qualified healthcare provider before starting any breathing exercise program, particularly if you have any pre-existing medical conditions, respiratory conditions, cardiovascular conditions, are pregnant, or have any concerns about your health.
If you experience dizziness, shortness of breath, chest pain, or any other adverse symptoms while using the App, stop immediately and seek medical attention.
You use the App and perform any breathing exercises entirely at your own risk. We are not responsible for any health consequences resulting from your use of the App.
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not download, install, or use the App.
The App and its entire contents, features, and functionality — including but not limited to all text, audio, visual content, graphics, logos, icons, breathing exercise designs, and software — are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not:

Prices are in United States Dollars and may vary by region due to Apple's regional pricing. We reserve the right to change subscription prices at any time, with changes taking effect at the start of the next subscription period.
We may offer a 7-day free trial for new subscribers. At the end of the free trial period, your subscription will automatically convert to a paid subscription at the rate of your chosen plan, and your Apple ID account will be charged accordingly. You may cancel the free trial at any time before it ends to avoid being charged.
All payments are processed through Apple's App Store. We accept payment methods supported by the Apple App Store, including Visa, Mastercard, American Express, and Discover. All payment information is handled exclusively by Apple — we do not collect, store, or have access to your payment details.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your chosen plan.
You may cancel your subscription at any time through your Apple ID subscription settings:
Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the end of the period you have already paid for. No partial refunds are provided for unused portions of a subscription period.
All purchases are made through Apple's App Store and are subject to Apple's refund policies. To request a refund, contact Apple directly through reportaproblem.apple.com. We do not process refunds directly.

The App may contain links to third-party websites or services that are not owned or controlled by us, including but not limited to Apple's subscription management pages and our hosted legal documents. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the App will be accurate or reliable.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Before initiating any formal dispute resolution proceedings, you agree to first contact us at tetherbreathwork@protonmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute through informal negotiation within thirty (30) days of receiving your notice.
If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration. The arbitration shall be conducted by a single arbitrator in Ahmedabad, India, in the English language. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended.
The arbitrator's decision shall be final and binding on both parties. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. To the extent that arbitration is not applicable, you agree to submit to the exclusive jurisdiction of the courts located in Ahmedabad, India.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review our Privacy Policy for more details.
We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, limitation of liability, and dispute resolution.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
